		<description>Joint custody is very common in California.  A parent has to demonstrate inability to care of the child to not receive joint custody.  The Judges try to get families to work out custody and visitation themselves through mediation.  This process is required and very few cases actually end up being decided by a judge.  90% of the time the judge rules with the mediator which is a therapist.  

I&#039;m not sure who wants to leave the state, but if you want joint custody you will have to keep the child in their current school and environment.

Generally, the court will give preference to whomever the child has been lived with most consistently and who the child looks to for moral guidance and discipline.  So if you are getting separated or divorced and you have children, don&#039;t move out.  You have no obligation to leave/lose your home.  

If you move out, you most likely will not get Joint Custody.  This is mostly because for an actual divorce to take place, it takes months if not years for it to actually finish up and THEN the court decides about the children.  If you have been away (not living with) your children for all that time, then the mother will say that you have become a virtual stranger to them.

On the issue of the child&#039;s preference, it is up to the judge if he/she will listen to what the child thinks.  Usually is the child is 12 years-old and up, then judge will consider his/her wishes.  But some judges really don&#039;t care.  

Lastly, look-up the legal codes that deal with child custody and child support.  If you have Joint Custody, then make sure that you still don&#039;t get manipulated into paying an absurd amount of support if any at all.  You should only be paying support if you make waaaaay more money than the mother does.  If she makes a lot more than you do, then she should be paying you.
